Terms of Trade
These Terms of Trade apply when you hire us for any quoted work in Mackay.
These Terms apply to all our work in Mackay. They're grouped by type of work: bond, pre-sale and interior cleaning; exterior cleaning (pressure wash, soft wash and gutters); handyman; lawn, garden and landscape; and commercial site maintenance. The General Terms at the end apply to every job. When you get an estimate or quote from us, or hire us, you agree to these Terms as far as they apply.
1. Bond, pre-sale and interior cleaning
Our cleaning team gets rental properties ready for exit inspections. We also do deep presentation cleans, including pre-sale cleans. Pre-sale cleans get the same level of care as bond cleans, within the quoted scope. For a bond clean, the points below help the job run smoothly and give you the best chance of getting your bond back.
Service Promise (bond / exit cleans)
If your property manager does the exit inspection and finds items we reasonably missed, we'll come back and reclean them. This only applies if nobody else has entered the property before the inspection. The property must also be inspected, and we must be told, within 3 days of finishing the clean. If we need to come back for items missed within our quote, we'll return as soon as we can, and within 4 working days of being told.
Entry report
Check the entry report you got when you signed the lease. Tell us about anything you're not responsible for, or anything that needs special attention, so we can allow for it in the quote.
Vacant property
The property must be completely empty before we start, including all furniture and belongings. Running late with the move? Tell us as soon as you can and we'll rearrange the booking.
Keys and access
We need keys, or agreed access, to the property. If you've already handed the keys back, we can collect them from the real estate agency. Tell us the day before the clean where the keys will be.
Bins and general waste
If cleaning the bins is part of the agreed work, empty them of general waste before the clean. If we need to arrange for them to be emptied, there may be an extra charge.
Remove any unwanted furniture or general waste. If you don't, extra charges may apply.
Unless we say otherwise, we use standard cleaning methods only. We may not be able to cover unusual or specialist cleaning, like smoke staining, mineral deposits, alfoil etching on windows or pet hair, or unusual or excessive dirt build-up.
Mould
We'll try to clean marks and mould from surfaces and walls where needed. We can't always remove every mark or mould stain.
Carpets
Our cleaners will do their best to remove spots and stains from carpets. We can't guarantee that every stain or odour will come out. Older or already damaged carpets may be damaged further by cleaning.
Shower screens and glass
We'll do our best, but we can't always remove calcium stains from shower screens or other glass.
Damage during cleaning
Sometimes we need to take an item apart or remove it to clean it properly, like oven doors, light fittings or toilet seats. We take great care. We can't take responsibility for damage caused by the wear or age of the part. If we think an item may be damaged by cleaning or taking it apart, we won't clean it and we'll tell you. Rarely, items get damaged even with great care. Tell us if there's anything you'd rather we didn't clean.
2. Exterior cleaning: pressure wash, soft wash and gutters
Pressure and soft wash
We clean your property safely and effectively with pressure and soft washing. We can't guarantee we'll remove every stain, or that we can fix damage that was already there. That includes loose paint, crumbling masonry and unstable surfaces. We aren't responsible for damage caused by poor maintenance, poor sealing, earlier cleaning attempts, or not following our before and after care advice. Talk to us about any concerns, so you get the best result.
Gutter cleaning
Gutter cleaning needs safe access to roof lines and high areas. Fragile, damaged or very steep roofs, brittle tiles or unsafe access may limit what we can safely do. If we need to stop or change the work, we'll tell you.
We dispose of gutter debris, or leave it, as your quote says. Blocked downpipes that need more than a simple clear, and repairs to gutters or roofing, aren't part of a standard clean unless the quote says so.
3. Handyman and general maintenance
Handyman and maintenance work is limited to the quoted scope. Anything outside it needs your agreement and may be a variation.
Hidden defects, unsafe conditions, concealed damage or problems we only find once work starts may need a variation before we can finish the job safely and properly.
Material warranties are generally the manufacturer's. Our workmanship guarantee is in the General Terms below.
We leave the work area as tidy as we reasonably can at the end of each visit, within the limits of the job and the site.
Where it applies, we can only carry out work that QBCC defines as construction work up to a maximum value of $3,300.
4. Lawn, garden and landscape
This section covers lawn mowing, garden maintenance (including hedging, tree pruning and weed spray), landscape installation and related outdoor work.
Outdoor work depends on the weather. Rain, extreme heat, high winds or unsafe ground may delay the job, and we'll reschedule as soon as we can. Light rain is often fine for garden work. We may move jobs in storms or on waterlogged ground, so we don't churn up the soil or leave a mess.
We take care with plants and turf. We can't guarantee they'll recover after pruning, transplanting, seasonal stress or weed treatment. Results depend on the species, the season, the soil and aftercare.
Please give us clear, safe access for mowers and garden equipment. That means open gates, unlocked areas, pets secured and vehicles moved. Extra time caused by blocked access may be charged.
We apply weed spray as quoted: the product, the areas and the method. Tell us before we start about irrigation systems, pets, children's play areas and any sensitive or valued plants. We'll work around them where we reasonably can.
Grass clippings, green waste and spoil are disposed of or left on site as stated in your quote. Changes to disposal arrangements may incur an additional charge.
Standard garden maintenance is looking after what's already in the beds. Supplying and planting replacement plants, or a one-off catch-up on a neglected garden, is quoted separately when it's outside a normal maintenance visit.
Ground-level hedge and shrub shaping and routine dead frond tidying can be part of a quoted scope. Work at height, large limb removal or anything that needs a ticketed arborist is quoted separately.
5. Commercial site maintenance
Commercial, retail, office, strata and body corporate grounds contracts are scoped to the site. That's usually mowing, edging, garden bed tidying, hedge and shrub trimming, blowing down paths and car parks, and a check of how the site looks. Extras like spraying, mulching, palm cleaning, irrigation checks and green waste removal are only done where quoted.
We follow your access process: keys, codes, contractor sign-in and induction. Our crews are easy to identify and insured, and can complete company or site inductions where needed.
The contract sets visit frequency and scope. We quote variations, like storm clean-up, extra pruning or new beds, before we do the extra work.
6. General Terms (all services)
These General Terms apply to every job we do, unless a written special condition says otherwise.
Interpretation
- These Terms form part of any agreement to do work under a work order, estimate or quote (we call all of these a "Quote") from GreenMan Property Services Pty Ltd (ABN 87 619 837 731).
- "Terms" means the terms and conditions in this document, plus any special terms we agree in writing.
- The "Client" is the person, company or entity asking for our services. If more than one party makes the agreement, each is jointly and severally liable for any amount owed. For example, a real estate agent who hires us for a landlord or property owner.
- "Services" includes the work and materials needed to finish the job. That means labour, materials, goods, equipment, and hire of specialised equipment and contractors.
Acceptance
- The Client accepts these Terms by getting an estimate or quote from us, or by hiring us, verbally or in writing. That includes when they act for someone else, such as an agent.
Pricing
- Our normal trading hours are 8am to 5pm, Monday to Friday. Our office answers calls and emails from 9am to 4pm. If the Client asks us to work outside those hours or on a public holiday, we may charge extra.
- Quoted prices are valid for the period on the quote. This applies as long as materials stay at the purchase price we used to prepare the quote. We may also review the pricing, at our sole discretion, if the quote is accepted within that period, but only on this condition.
- The quote only covers the services set out in its "Scope of Work".
- We can change the quote to account for:
- Related services needed to complete the work that aren't in the Scope of Work
- Extra services the Client asks for or needs after work starts that weren't in the original quote
- Any increase in the cost of materials
- Any price change from a third party we engage to complete the work
- If you cancel a work order, verbal instruction or accepted quote, we may charge a fee. It covers costs we've actually incurred in starting the work, including materials we've bought and labour we've set aside.
- We may charge 'cost plus' on equipment, equipment hire, specialised skills, materials, fuel and similar items needed to complete the requested work.
- We may charge extra for emergency and urgent jobs. An emergency is a situation we need to attend within 2 hours of the request. Urgent means within 12 hours.
- We charge for travel time to and from the site, time to find and buy materials if needed, time on site doing the work, and time spent waiting for the Client to make decisions.
Payment Terms
- Materials we use stay our property until the Client has paid all outstanding invoices in full.
- Payment options are on the invoice. We accept MasterCard and Visa.
- We may ask for a deposit before starting work. We may also ask for progress payments as the work is partly completed.
- If the Client doesn't make an agreed progress payment, we may stop work until we're paid.
- Pay all accounts by the due date on the invoice.
- GreenMan Property Services reserves the right to charge Administration fees with a monthly fee of twenty-five dollars ($25) plus GST for accounts not paid within GreenMan Property Services’ agreed payment terms.
- GreenMan Property Services may charge interest at two percent (2%) plus GST above the Commercial Lending rate of the GreenMan Property Services’ bank calculated daily on amounts not paid within GreenMan Property Services payment terms.
- If the Client doesn't pay what they owe, they must pay us for any costs, expenses or losses we incur because of it. That includes debt collection and legal costs of enforcing payment, on a solicitor and own client basis.
- If an agent hires us for a third-party client and we can't recover the debt from that client, we may recover it from the agent who issued the work or quote request.
Workmanship
- We guarantee our handyman workmanship for six months. The guarantee covers labour only. The warranty on materials is generally the manufacturer's.
- As far as the law allows, our liability is limited to the amount the Client owes under the Quote or invoice for completed work. This covers liability in contract, tort or otherwise, direct or indirect, for supplying the services or for anything we do or fail to do under the estimate.
- If we tell the Client that materials they supplied, or a work method they asked for, aren't good enough, and they still want to go ahead, our labour guarantee no longer applies.
- Our warranty no longer applies if materials are reinstalled elsewhere, modified, altered, damaged or put under undue stress beyond what they were designed for.
- We'll use reasonable care, skill and diligence. We'll make sure the work is of good enough quality and done within a reasonable time. The Client is only entitled to a remedy from us when our work doesn't meet the consumer guarantees for services in the Australian Consumer Law.
- Whatever else these Terms say, we are never liable, whatever the cause, to compensate the Client for:
- increased costs or expenses, or any loss of profit, revenue, business, contracts or expected savings
- loss or expense from a claim by a third party
- special, indirect or consequential loss or damage of any kind caused by a reasonable delay in completing the work
Completion of Work
- We'll try to start and finish the work as soon as possible after you hire us. This depends on labour and materials being available, public holidays and the weather.
- The Client must give us exclusive access to the site to do the work. We'll charge the Client for parking costs at the site, and for any losses or expenses we incur because site access is interrupted.
- We aren't responsible for problems that only show up once work has started. If fixing them is needed to finish the job safely and properly, we'll do it. Extra work caused by something unforeseen is a variation, and the pricing variation terms above apply. If we don't agree a price, we charge actual cost plus 20%, plus GST.
- The hourly rate for 'Do and Charge' work may change if we hit hidden conditions or obstacles that need special equipment to finish the job.
- If the Client changes or increases the scope of an accepted quote, work order or verbal instruction, the Client must cover any extra cost we incur (indemnify us). Variations are payable on our usual payment terms.
Privacy
- The Client authorises us to collect, keep, record, use and share commercial or consumer information about the Client, in line with the Privacy Act 1988 and the Privacy Principles in the Privacy Amendment Act 2012. We may share it with a solicitor or other professional adviser we engage, a debt collector, a credit reporting body, or anyone who keeps credit references or default listings. We may share this information before, during or after giving the Client credit.
- If an agent hires us for a third-party client, the agent must give us the client's full contact details when we ask. The agent must also help us recover any debt owed on unpaid accounts.
